Terms and Conditions:
By accessing customer information in the Electricity Supplier Marketplace, you agree that:
a. CMP will make available to you only such data as each individual customer has specified and some customer data, such as phone number and e-mail address, may not be made available.
b. You may receive up to 13 months of historical hourly interval data for customers that have elected to participate in the Electricity Supplier Marketplace. If less than 13 months of data exists for a customer at their current location, CMP will provide only such data that is available for the customer at that location.
c. CMP will provide data only for such customers as are currently enrolled in the Electricity Supplier Marketplace. Customers may de-enroll from the Electricity Supplier Marketplace at any time. Customers are automatically de-enrolled when they end service or remove their account from an online profile. CMP will not provide you with any updates to any customer data that you have obtained via the Electricity Supplier Marketplace, for example, when a customer closes their CMP account or otherwise de-enrolls from participation in the Electricity Supplier Marketplace.
d. You will not sell or otherwise provide to a third party any electricity usage data or other customer information obtained in the Electricity Supplier Marketplace. You may only use such data or customer information for purpose of marketing your electricity supply products to such customers.
e. Both customers and competitive electricity providers will access the Electricity Supplier Marketplace by entering CMP’s secure website with a username and password.
f. CMP will cease disclosure of customer information through the Electricity Supplier Marketplace when: (1) the customer rescinds his or her authorization, (2) the authorization expires, or (3) the customer’s CMP account is closed.
g. You may retain customer data collected through the Electricity Supplier Marketplace only as long as needed to fulfill the purpose it was collected for, but in no event longer than ninety (90) days, unless you are under a legal obligation to do otherwise, in which case you may retain such data for such period as is legally required but you may not use such data for any purpose other than document retention.
h. You will securely and irreversibly dispose of or de-identify customer data collected through the Electricity Supplier Marketplace upon the earlier of (i) once you have reasonably determined that such data is no longer necessary to achieve the purposes for which it was collected or (ii) ninety (90) days from receipt of the customer data, unless you are under a legal obligation to retain such data for a longer period, in which case you may retain such customer data but may not use such data for any purpose other than document retention.
i. You will maintain records identifying whatever downloads of customer data you have obtained through the Electricity Supplier Marketplace.
j. LIMITATION OF LIABILITY - CMP SHALL NOT BE LIABLE FOR ANY CLAIMS OR DAMAGES (INCLUDING DIRECT, INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES) ARISING FROM YOUR ELECTCTION TO USE THE ELECTRICTY SUPPLIER MARKETPLACE, REGRADLESS OF HOWEVER SUCH DAMAGE ARISE, WHETHER FOR BREACH OF CONTRACT OR IN TORT.
k. The Electricity Supplier Marketplace and its content are provided on an "as is" basis. CMP does not represent or warrant that the functions of the Electricity Supplier Marketplace or the materials therein will be provided on an uninterrupted basis or are error-free, or that defects will be promptly corrected. CMP, to the fullest extent permitted by law, disclaims all warranties, express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties' rights and fitness for a particular purpose.
